By accessing or using Oskkee ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

Oskkee is a service operated by Indslav Joog Private Limited ("we", "our", or "us"), a company registered in India. These Terms apply to all users of the Service, including brands, agencies, and individual users.

2. Description of Service

Oskkee is an AI-powered creator discovery platform that helps businesses find relevant content creators and influencers for marketing collaborations. Our services include:

• Creator and influencer discovery across social media platforms
• Profile analysis and engagement metrics
• AI-powered search and recommendations via WhatsApp
• Creator categorization and ranking
• Hashtag-based creator discovery using Instagram content
• Creator Marketplace search with audience demographics
• Comment and sentiment analysis on creator content
• Direct messaging outreach to creators on behalf of brands

3. User Accounts

3.1 Account Creation

To use our Service, you must provide your WhatsApp phone number. By doing so, you confirm that:

• You are at least 18 years old
• You have the authority to enter into these Terms
• The information you provide is accurate and current

3.2 Account Security

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Tokens and Payment

4.1 Token System

Our Service operates on a token-based system. Tokens are consumed when you perform searches that return results.

4.2 Token Purchases

• Tokens can be purchased through our platform
• All purchases are final and non-refundable unless otherwise required by law
• Unused tokens do not expire

4.3 Pricing

We reserve the right to change our pricing at any time. Any price changes will not affect tokens already purchased.

5. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract our algorithms
• Scrape, copy, or redistribute data obtained through our Service
• Use automated systems to access the Service without permission
• Harass, spam, or send unsolicited messages to creators found through our platform
• Misrepresent your identity or affiliation
• Use creator information for purposes other than legitimate business outreach
• Violate any applicable laws or third-party rights

6. Creator Data and Third-Party Platforms

6.1 Public Data

Our Service aggregates publicly available information from social media platforms. We do not guarantee the accuracy, completeness, or timeliness of this data.

6.2 Platform Compliance

When using data obtained through Oskkee, you must comply with the terms of service of the respective social media platforms (Instagram, Twitter/X, YouTube, TikTok, Pinterest, LinkedIn, etc.).

6.3 No Endorsement

The appearance of creators in our search results does not constitute an endorsement or verification of their suitability for your purposes. You are responsible for conducting your own due diligence.

6.4 Instagram API Data

Oskkee uses the Instagram Graph API to access creator data with the following permissions:

• Profile Data (instagram_basic): Creator profiles including username, biography, follower count, and profile picture are displayed in search results. This data may be cached for up to 90 days to improve response times.
• Engagement Insights (instagram_manage_insights): Post-level and account-level metrics are used to calculate engagement rates. Insights data is refreshed periodically and not stored permanently.
• Comment Data (instagram_manage_comments): Comments are analyzed for sentiment and engagement quality. Comment data is processed in real time and not stored beyond the analysis session unless aggregated.
• Direct Messages (instagram_manage_messages): Partnership inquiry messages are sent only with explicit user authorization. Message content and delivery status are logged for up to 90 days for service quality and compliance purposes, then automatically deleted.
• Creator Marketplace (instagram_creator_marketplace_discovery): Creator search results from Instagram's Marketplace include audience demographics and engagement metrics. This data is used to enhance search accuracy and is subject to Meta's data usage policies.
• Hashtag Search (Instagram Public Content Access): Public posts found via hashtag search are used to identify creator profiles. Post content is processed for creator extraction and not stored beyond the search session.
• Facebook Pages (pages_show_list): We retrieve the list of Facebook Pages managed by a user to identify the Instagram Business account linked to each Page. This is a technical prerequisite required by the Instagram Graph API.
• Page Engagement (pages_read_engagement): We read engagement data through the Facebook Page node, which is required to access Instagram engagement metrics via the Graph API. Page engagement data is not stored beyond the analysis session.

By using Oskkee's Instagram-powered features, you agree to comply with Meta's Platform Terms and acknowledge that creator data accessed through these features is subject to Meta's data usage policies.

7. Intellectual Property

7.1 Our Property

The Service, including its algorithms, design, and technology, is owned by Indslav Joog Private Limited and protected by intellectual property laws. You may not copy, modify, or create derivative works without our permission.

7.2 User Content

You retain ownership of content you submit to us. By using our Service, you grant us a license to use your search queries and feedback to improve our algorithms.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Search results will be accurate or complete
• Creators found will be available or interested in collaboration
• Any specific business outcomes will be achieved

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OSKKEE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Any damages arising from your use of or inability to use the Service

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Indslav Joog Private Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your outreach or communication with creators

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service ceases immediately
• Unused tokens may be forfeited
• We may delete your account data after a reasonable period

12. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes through our platform or via WhatsApp. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
